These Terms and Conditions are intended as signed by DifferentDating/Infomycity and each Member.
DifferentDating and Infomycity companies offer, through electronic communication networks, services aimed at promoting virtual meetings between people for private, leisure and non-commercial purposes.
All features are accessible to Members free of charge (for a certain daily hour, or otherwise depending on active promotions).
Membership, as well as the use of the services offered, presupposes full and complete acceptance of these Terms of Use by the Member or Member. Therefore, by creating an Account, you acknowledge that you are fully informed and bound by all the provisions of these Terms of Use.
Our PRIVACY and OUR COOKIE POLICY form an integral part of these Terms and Regulations.
The definition Services identifies the Site or APP. (so for Site or Ap. both modalities are identified) identifies the ways to use DifferentDating.
You can access the WEB portal only if you have already installed the DifferentDating application and only through an identification code generated by the application.
NOTE: DifferentDating's dating service is based on your precise geolocation (latitude and longitude) by various means, depending on the service and device you are using, including via GPS, Bluetooth or Wi-Fi. The collection of information on your geolocation can only take place when you are using the services, through different options of visibility you can choose the most appropriate at the time.
1) Procedure and conditions for access to and registration for DifferentDating services
Registration for the Services is free of charge. The Visitor, Member or Member shall bear only the costs of the equipment enabling them to access the Services, as well as the costs arising from their use.
Acceptance of these Terms and Conditions at the time of registration constitutes the conclusion of the membership contract.
To register and become a member, any interested visitor must be at least 18 years of age, meet the requirements for registration or access to our Services, be legally able to enter into a contract, read these Terms of Use and Regulations, read the Cookie Usage Policy and Privacy Policy, and complete all required fields on the registration form.
A member may not create more than one Account with the same email address (but will have two profiles)

The Member is responsible for the use of his/her identifiers by third parties or the actions or statements made by an intermediary through his/her Account, whether fraudulent or not, and will hold DifferentDating harmless from any claims that may arise, except in the case of liability attributable solely to DifferentDating for technical failure of the Services. In any case, DifferentDating is under no obligation and does not have the technical means to verify the identity of persons who register. If the Member or Member has reason to believe that a third party is using their own identifiers or their Account, they should immediately inform DifferentDating.
2) In accordance with article L 221-18 of the French Consumer Code, you are informed that you have a period of fourteen days from the purchase of a Subscription to exercise your right of withdrawal, without penalty and without giving any particular reason, by writing an email (help.world@outlook.com), OR WRITING TO: Infomycity sasu, c/o CB Service, 4 Rue Des Freres Picco, 06500 Menton France. Communications sent to this address will be processed only if related to the exercise of the right of withdrawal. In order for the withdrawal to be effectively exercised, the member must send their request within fourteen days of the duration of the withdrawal period.
The refund will be made within 14 days from the date on which Infomyole was informed of the Member's decision to withdraw, using the same payment method used by the Member for the initial transaction, unless otherwise expressly agreed with the Member.
The subscription to the services of DifferentDating (excluding promotions or other free special offers) will only be valid for one month, the only form of subscription will be for one month, after which from five days before the expiration you can renew, without renewal you can continue to use all the services offered but with a fixed daily time.
3) Registration to the DifferentDating allows individuals to become Members allowing access to all the features: create a Profile, which will be visible to other Members and Members of the Site, subject to the access restrictions set by the member, conduct searches and see compatible Profiles. 6) Obligations of Members
The provisions of this article are applicable from the time of registration or Subscription and remain applicable for the entire duration of use of the services provided by DifferentDating.
To use DifferentDating, the Member undertakes to comply with all applicable laws, to respect the rights of other Members, as well as to observe the obligations defined below:
It is strictly forbidden to publish photos or videos with pornographic images, photos or videos of nudes and/or intimate parts or any other image or video that disturb the common sense of modesty.
Therefore, the Member must not, without this list being exhaustive and complete, communicate, disseminate, share, make accessible, in any way and for no reason, his password or username to different parties, whoever they are.
The violation of this obligation constitutes a serious violation by the Member of his contractual obligations.
In case of violation of one or more obligations by the Member, DifferentDating may terminate the contract and permanently delete the Member's Account(s) on all sites of DifferentDating and Infomycity.
7. Prices, deadlines and payment methods.
In order to use DifferentDating unlimitedly, the Member must have a Monthly Only Subscription; the prices and payment methods are described on the website in question. Subscribers can buy a Subscription by credit card, paypal or other forms of payment (via the Internet or mobile services or on the App. store), depending on the options indicated on the relevant DifferentDating Site. The main ones will be indicated in Euro (taxes included). Where expressly indicated in other currencies. If in compliance with the regulations in force in the various countries, payment will also be allowed with virtual coins (bitcoin or other).
8) Subscription renewal, clear agreements.
At the end of the month of validity, the Subscription will be terminated, the subscriber can buy another single month. With our Clear Pact no cheating, you will only pay for the single month (for example from the 21st to the 21st of the following month). With us, no tacit renewal or such scams, you only pay one month at a time and if you want. 9) Other services provided by Infomycity.
The Member may also subscribe to other services provided by Infomycity (even if not a subscriber), future services will be advertised on the site DifferentDating or Infomycity. The methods of invoicing and payment will be described by the same service.
10) Intellectual property and CopyRight. All names, logos, graphics, photographs, animations, videos and texts contained on the Site and in the Apps of DifferentDating and Infomycity are the exclusive property. They cannot be reproduced, used or communicated without the explicit authorization of the companies of the Infomycity sasu. Violators will be prosecuted.
The right of use given to members is limited to private and personal use within the scope and for the duration of registration for the Services. Any other use by the Member is prohibited.
The member is forbidden, among other things, to modify, copy, reproduce, download, disseminate, transmit, commercially exploit or distribute in any way any service offered by DifferentDating/Infomycity, the pages of the Sites or the computer codes of the elements that make up the services and sites in any way; offenders will be severely and legally prosecuted.
11) Content disclosed by members
The Member grants DifferentDating/Infomycity a licence to use the intellectual property rights linked to the content provided by the Member in connection with the registration or Subscription and the use of the services in question and to display his/her Profile on the website or app. This license includes in particular the right of Infomycity to reproduce, present, adapt, translate, digitize, use for the purposes of the service in question or sub-license the content provided by Members (information, images, description, search criteria, or other), on all or part of them and on all sites, in general in all means of electronic communication (e-mail, Internet, mobile applications) within the scope of the services in question.
The member expressly authorizes Infomycity to modify the aforementioned content to comply with the graphic criteria and / or other communication media presented above and / or make them compatible with its technical features or formats supported by the media. 12) To use DifferentDating, the Member must have the skills, equipment and software required to use the Internet or mobile applications. 13) The information provided by a member of DifferentDating must be accurate and true to life. DifferentDating cannot be held responsible for the accuracy or inaccuracy of the information and content provided by members to other members and vice versa, nor for the consequences arising from the use of this information and content. Furthermore, it cannot be held responsible for any content disclosed by a member that may infringe the rights of one or more members.
DifferentDating/Infomycity shall not be liable for any damage suffered by the Member caused by the Member himself or by any event of force majeure.
Members acknowledge and accept that the data they provide, as well as their behavior or comments made through the DifferentDating, may be subject to reporting by other members and monitoring, based on objective evaluation criteria. If such a report or check reveals that a Member is in breach of the laws and regulations in force or of its contractual obligations under these Terms of Use and Regulations. DifferentDating can exclude the Member by deleting his/her Account. All illegal actions will be reported to the competent authorities.
DifferentDating has no control over its sites or applications or over external sources to which they redirect hyperlinks accessible from sites. We are not responsible for the presence of links to third party sites and will not be held responsible for their content, advertising, products, functionality, or any other element, whose manifestly illegal nature has not received actual and prior notice, by means of a notification in accordance with the provisions of Article 6.I.5 of French Law No. 2004-575 as in force from 1 January 2017. Please note that the consultation and use of third party sites is governed by these terms of use and regulations and that such consultation and use will be made under the full and exclusive responsibility of the Member.

14) Each Member can, at any time, cancel their registration to DifferentDating and their Subscription through the section "General settings". By deleting your profile all information, chat photos and anything else will be deleted permanently without any chance of recovery.
15) In the event of a serious breach by the Member, DifferentDating may permanently remove the Member's Account(s) without notice. This removal will not entitle the member to compensation, the member will be informed by e-mail of the closure of his account, the closure will not prevent the claim for damages that DifferentDating may make against the member or his assignees and legal representatives to repair any damage suffered by DifferentDating as a result of such violations.
16) These Terms and Regulations constitute a contract governing the relationship between the DifferentDating Member and the Infomycity company.
In the event that one or more provisions of the Conditions and Regulations are declared null and void by application of a law, a rule or following a final judgement of a jurisdiction or a competent authority, the other provisions shall remain in full force and effect, to the extent permitted by the law, the rule or the decision of the competent court. Your personal data will be processed in accordance with the Privacy Policy and in accordance with the GDPR 2018 European Regulation for the Protection of Personal Data (Our previous CNIL 1698463 v 0 of 9-9-2013) and an integral part of this contract, together with our cookie policy.
17) DifferentDating may modify this contract at any time and the Member will be informed of such modifications as soon as they become effective, the new conditions are subject to the Conditions and Regulations in force at that time. Users who do not accept the changes may stop using DifferentDating. If a monthly subscription is in progress, the new conditions and regulations will only be valid at the end of the subscription period.

These Terms and Conditions are governed by, construed and applied in accordance with French law, without prejudice to the mandatory provisions of the Member's or Member's country of residence. The language of interpretation is French.
In accordance with the provisions of the French Consumer Code relating to the amicable settlement of disputes, the Member or Member may also submit his/her complaint to the online dispute resolution platform hosted by the European Commission at: http://ec.europa.eu/consumers/odr/. The European Commission will transfer the Member's or Member's complaint to the relevant national mediation body.
In accordance with the rules applicable to mediation, prior to any request for mediation, the Member or Member must first submit the complaint to DifferentDating/Infomycity, in writing, in order to attempt an amicable solution.
In the event that, in a dispute relating to the Conditions and Regulations, an amicable solution cannot be found, the competent authorities will always preferentially be the court of Nice (France) or if otherwise agreed between the parties or different legal provisions, courts of the country of residence of the consumer in one of the member countries of the European Economic Area.
